Description: The prosecution and investigation of DUI offenses are some of the most difficult cases for both prosecutors and law enforcement. However, despite such difficulties, these cases can be much more efficiently and effectively investigated and

prosecuted when a law enforcement officer has simply asked the right questions in the right way during Phase Two of DUI detection. Interrupting questions that divide the driver’s attention are a staple of Phase Two’s Personal Contact. During his over fifteen-year career – including six years as a dedicated DUI Unit and over 1200 DUI investigations – Cpl. Aaron Botts of the Denver Police Department has taken the typical questions officers have been trained to ask for decades, and put them in a precise order, with new follow-up questions. Throughout this session, Cpl. Botts will explain this simple but effective technique that has allowed him to better detect and subsequently arrest impaired drivers that may have otherwise been left on the road. Such information will allow law enforcement officers to hone their Phase Two investigatory techniques, and it will provide prosecutors with better information of what to look out for as they review Phase Two of DUI cases that cross their desks.

Description: With increasing legalization of cannabis for recreational and medicinal uses, it is critical to identify drivers who are, or are not, impaired due to use. While field sobriety tests (FSTs) are the gold standard for determining impairment at roadside, questions have been raised regarding their sensitivity to cannabis-related impairment, the frequency with which non-intoxicated individuals do poorly on FSTs, and the risks of confirmation bias in attributing possible reasons for poor FST performance. This presentation will address these issues in the context of the largest, randomized clinical trial of the effects of cannabis on driving performance, in which participants were evaluated on the FSTs by highly trained drug recognition experts. Understanding the strengths and limitations of findings from this study will allow officers to better investigate DUI-C cases and provide prosecutors with updated background that will benefit the evaluation and prosecution of these offenses.

Description: This session is designed to walk a prosecutor through a report in a Drug DUI case and how to properly evaluate evidence in that report. It will then introduce both prosecutors and law enforcement to the DRE Matrix to better allow for them to prepare the case more properly for trial using that matrix. In addition to covering standards for filing cases and conducting trial, this session will discuss necessary pretrial investigative steps that should be taken before trying a Drug DUI case. It will also familiarize prosecutors and law enforcement with other tests that might be used to evaluate an impaired driver when drugs are suspected, and things to look for to better prove the case. This session will also cover admitting the DRE matrix as an exhibit in trial, including what objections to anticipate and how to overcome them.

Description: Forensic toxicologists apply scientific principles to the testing of biological samples for alcohol and other drugs. Then in court, they discuss the accuracy and reliability of those testing results and can educate the judge/jury on how drugs can impact driving. This session will discuss the technology used by forensic toxicologists to identify potentially impairing substances. Topics include the theory of each analytical technique, the types of specimens that can be tested (blood, urine, and oral fluid), measurement uncertainty, and the checks and balances that allow for confidence in the testing results. The role of the toxicologist in impaired driving investigations will be discussed, including what they can and cannot say in court. Such information is designed to better educate both prosecutors and law enforcement as to the true role of the forensic toxicologist in the Drug DUI case so that full benefit of the services of such a forensic toxicologist can be applied to that case.
